Dear HUFS faculty members, Thank you for your continued dedication to and hard work in both research and teaching. The Office of Academic Affairs kindly requests your attention and cooperation related to granting excused absences and offering make-up academic support to students who are unable to attend classes due to reserve military training. Recent media coverage has highlighted regrettable instances where: students were penalized in terms of their grade or given a class absence during reserve training; students received a score of zero on a quiz (preliminary tests) because they were unable to take it due to their absence for military training; and students asked for the materials from a lecture they missed due to military training in order to make up for it, but their request was rejected. The Reserve Forces Act and Military Service Act of the Ministry of National Defense require that academic institutions guarantee the right to study for students participating in reserve training (student reservists), and an amendment (Article 11-2 Prohibition of Disadvantageous Treatment Due to Reservist Training) to the Enforcement Decree of the Higher Education Act will be enacted in October 2023. As such, the Korean law is reinforcing its commitment to safeguard the educational rights of student reservists, and both Campuses' student government associations are reemphasizing their call for excused absences and the availability of course materials and recorded lectures for these students. Therefore, we request your careful attention and that you take the following measures to ensure that students fulfilling their military service obligations (reservists) are not academically disadvantaged due to their participation in reserve training. ◾ Approving excused absences via the Electronic Attendance Management System(“EAMS”) ◾ Providing lecture materials, content, or recorded lectures ◾ Giving supplementary assignments and other various alternatives to prevent grading disadvantages We kindly ask for your understanding and cooperation. [Reference 1] Related Laws 「Military Service Act」 Article 74-3 (Military Force Mobilization and Guarantee of Training-Related Academic Security) The head of a high school or higher education institution shall not classify students as absent or subject them to unfavorable treatment solely based on their compliance with a summons outlined in the following provisions. Mobilization of troops, training for mobilization, wartime duties, or wartime labor mobilization assessments in accordance with Articles 44 through 54 Summoning of individuals for alternative reservist service as defined in Article 26-1 of the Act on Assignment to and Performance of Alternative Service 「Military Service Act」 Article 93-2 (Military Force Mobilization and Violation of Guarantee of Training-Related Academic and Job Security) In cases where the head of a school or an employer, etc., provides unfavorable treatment without justifiable grounds, in violation of Article 74-3 or 74-4, he/she shall be subject to punishment by imprisonment for a maximum of two years or a fine of up to 20 million won. 「Reserve Forces Act」 Article 10-2 (Military Force Mobilization and Guarantee of Training-Related Academic Security) The head of a high school or higher education institution shall not classify a student as absent during the period of mobilization or training as a reserve army member nor subject the student to unfavorable treatment based on such mobilization or training. 「Reserve Forces Act」 Article 15 (Penalties) ⑧ A person who, without justifiable grounds, treats an individual who is mobilized as a reserve army member or undergoing related training unfavorably in violation of Articles 10 and 10-2 shall be subject to punishment by imprisonment for a maximum of two years or a fine of up to 20 million won. 「Amendment to the Enforcement Decree of the Higher Education Act (to be enacted)」 Article 11-2 (Prohibition of Disadvantageous Treatment Due to Reservist Training) The head of an educational institution shall not subject a student fulfilling reserve training under Article 6 of the Reserve Forces Act to any form of disadvantage in relation to attendance monitoring, grading procedures, or access to learning materials throughout the duration of the training period. The head of an educational institution shall guarantee students' right to learn, including their right to make up for missed classes due to reserve training commitments. |
